2. Client Responsibilities

Clients agree to:

  • Review deliverables and provide timely feedback.
  • Obtain all necessary rights and permissions for materials supplied to us.
  • Make payments according to the agreed schedule.

Project timelines may be extended if required information or approvals are delayed by the client.


3. Pricing & Payments

All pricing is provided in quotations or proposals.

Unless otherwise agreed:

  • Payments must be made according to the agreed payment schedule.
  • Late payments may delay project delivery.
  • Additional work outside the agreed scope may incur additional charges.
  • Prices are subject to applicable taxes where required by law.

4. Project Revisions

Each project includes the number of revisions specified in the proposal or service agreement.

Requests beyond the agreed revision limit or changes outside the original project scope may require a revised quotation and additional fees.


5. Intellectual Property

Unless otherwise agreed in writing:

  • Hyperwire retains ownership of all preliminary concepts, drafts, source files, and proprietary development methods until full payment has been received.
  • Upon receipt of full payment, ownership of the final approved deliverables is transferred to the client, excluding third-party software, fonts, plugins, stock assets, or licensed materials that remain subject to their respective licenses.
  • Hyperwire may display completed work in its portfolio, website, and marketing materials unless a written confidentiality agreement states otherwise.

6. Third-Party Services

Projects may rely on third-party providers, including domain registrars, hosting companies, payment processors, analytics platforms, advertising networks, and software vendors.

Hyperwire is not responsible for outages, pricing changes, service interruptions, policy changes, or other issues caused by these third parties.


7. Website Maintenance

Unless covered under an active maintenance agreement, clients are responsible for:

  • Website updates
  • Security monitoring
  • Software updates
  • Backups
  • Performance optimization

Maintenance services are available under separate agreements.


8. SEO & Marketing Disclaimer

Search engine rankings, website traffic, leads, and advertising performance depend on many external factors beyond our control.

While we follow industry best practices, Hyperwire does not guarantee:

  • First-page search rankings
  • Specific keyword positions
  • Sales or revenue targets
  • Advertising results
  • Social media growth

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the project, except where disclosure is required by law.


10. Limitation of Liability

To the maximum extent permitted by law, Hyperwire shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services or website.

Our total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.


11. Termination

Either party may terminate a project by providing written notice.

If a project is terminated:

  • The client is responsible for payment for all work completed up to the termination date.
  • Any outstanding balances become immediately payable.
  • Completed deliverables will be provided only after outstanding payments have been received.

12. Refunds

Refund requests are governed by our separate Refund & Return Policy, which forms part of these Terms.


13. Privacy

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.


14. Website Use

Users agree not to:

  • Use our website for unlawful purposes.
  • Attempt unauthorized access to our systems.
  • Upload malicious software or harmful code.
  • Interfere with the operation or security of the website.
